Mom Agreement
Effective October 15, 2026. This agreement applies to everyone who offers or performs Tasks on Momsity as a Mom. It adds to the Momsity Terms of Use, including the arbitration agreement and class-action waiver in Section 19 of those Terms.
1. Who is a Mom
“Mom” is the Momsity name for an individual or business that offers or performs eligible Tasks for Members through the Platform. You do not need to be a parent. You must be at least 18 years old and legally able to work in the United States.
2. Independent business relationship
You are an independent contractor operating your own business. You are not an employee, agent, joint venturer, or partner of Momsity, and you are not entitled to wages, overtime, benefits, workers' compensation, or unemployment insurance from Momsity. You decide whether, when, and where to use the Platform, which Tasks to offer on or accept, and how to perform them, subject to the Task details, safety rules, and law. You may use the Platform alongside other work, including competing platforms, as long as you do not take Momsity-introduced Tasks off the Platform. You may not hold yourself out as an employee or agent of Momsity.
3. Eligibility and qualifications
You must give accurate information and keep it current. Some Task types (for example, rides, moving, or car help) require additional qualifications. You represent that you hold any license, valid driver's license, vehicle registration, insurance, permit, or skill required by law or by the Task, and you will accept only Tasks you can perform safely and lawfully. Momsity may set and change eligibility rules, service areas, trust levels, and matching criteria at any time.
4. Your responsibilities
- Perform accepted Tasks honestly, safely, and as described.
- Communicate through the Platform and keep Member information private.
- Show up on time, or cancel in the app as early as possible if you cannot.
- Mark a Task complete only after it is actually done.
- Never ask for or accept payment outside the Platform for a Momsity Task.
- Never use Momsity to find a Member and then take that Member's Tasks off Momsity.
- Do not offer or perform prohibited Tasks, and follow the Community Rules.
- Do not harass, discriminate against, or misuse information about any Member.
5. Payouts
- You see your payout for a Task before you offer or accept. Momsity's service fee is the difference between what the Member pays and your payout.
- The Member's payment is held until the Task is confirmed. The Member may confirm completion after you mark the Task complete. If the Member does not confirm or open a review, Momsity may confirm the Task automatically 72 hours after you mark it complete, as long as no review, dispute, or open safety, payment, or eligibility issue applies and the Member's payment has settled.
- Once a Task is confirmed, your earning is recorded. Eligible earnings may then be transferred to your connected Stripe balance when your Stripe payout account is ready. Confirmation and transfer are not a bank deposit.
- Payouts are sent through Stripe Connect. You must complete Stripe's onboarding and verification and agree to Stripe's terms. Deposits from your Stripe balance to your bank follow Stripe's payout schedule and may take additional time; Momsity does not guarantee when a transfer or deposit will arrive.
- Payouts stay on hold while a Member review, dispute, or chargeback is open, or when Momsity reasonably suspects fraud, error, or a policy violation.
6. Refunds, chargebacks, and recovery
If a Task is refunded, not performed, performed fraudulently, or paid in error, or if a Member's payment is reversed through a chargeback that Momsity does not win, you authorize Momsity to withhold, reverse, or offset the related payout, including by reversing a Stripe transfer or deducting the amount from future payouts, and you agree to repay any remaining amount on request.
Automated decisions. Momsity may decide routine Member reviews with automated rules. A quality concern you answered with your side and completion proof may be decided in your favor, which releases your earning the normal way; a no-show you did not reply to within 48 hours may be decided for the Member, which refunds the Member only if no money has reached you yet. Earned promotional bonuses (such as the First 3 Tasks Bonus) may be paid automatically after a review window, and services may be approved automatically once your required credentials are approved. Each decision is logged with its reasons and you are told by email; you may ask for a human review of a review decision within 14 days. Safety, injury, damage, theft, fraud, chargebacks, and larger amounts always go to a person, and automated tools never suspend or deactivate your account on their own.
7. Taxes
You are responsible for all taxes on your earnings and for any business licenses or registrations you need. Momsity or Stripe may collect tax information from you and issue tax forms (such as Form 1099) where required by law.
8. Insurance and risk
Momsity does not provide insurance for you, your vehicle, or your property, and does not cover injuries or damage that happen during a Task. You are responsible for carrying any insurance required by law or that you consider appropriate, including auto insurance that covers Tasks involving your vehicle. You perform Tasks at your own risk, as described in the release in the Terms of Use.
If you take pet, house-sitting, or other Tasks inside a Member's home, you are solely responsible for following the Member's instructions, using keys and access codes only for that Task and returning them, and caring for any animal or property left with you. Momsity does not cover injuries to you (including animal bites), harm to animals, or damage to or loss of property during these Tasks. House sitting requires Momsity approval before you can offer it.
9. Reviews, trust level, and deactivation
Members may review your work. Momsity may use reviews, completed Tasks, reliability, cancellations, and reports to set your trust level and matching. Momsity may limit, suspend, or deactivate your access for safety, fraud, policy violations, repeated cancellations or no-shows, or legal reasons.
10. Indemnification
You agree to defend, indemnify, and hold harmless Momsity and its owners, members, managers, employees, and agents from any claims, damages, losses, fines, and expenses (including reasonable attorneys' fees) arising from the Tasks you perform, your vehicle or property, your taxes, your classification, or your violation of this agreement, the Terms of Use, or the law.
11. Disputes and governing law
Disputes between you and Momsity, including disputes about your classification or payouts, are resolved by binding individual arbitration under Section 19 of the Terms of Use, with the same class-action waiver, small-claims exception, and 30-day opt-out. This agreement is governed by the laws of the State of Michigan and the Federal Arbitration Act.
12. Changes and contact
