Momsity Terms of Use
Effective October 15, 2026. Please read these Terms carefully. Section 19 contains a binding individual arbitration agreement and class-action waiver that affect your legal rights, including how disputes with Momsity are resolved.
1. Who we are and agreeing to these Terms
Momsity™ is a DBA of Ryan Lenhart LLC (“Momsity,” “we,” “us”). These Terms of Use (“Terms”) govern your access to and use of momsity.com, our apps, and related services (the “Platform”). By creating an account, checking an acceptance box, posting or accepting a Task, or otherwise using the Platform, you agree to these Terms, our Privacy Policy, the Community Rules, the Prohibited Tasks Policy, and the Cancellation & Refunds policy, each of which is part of these Terms. Moms also agree to the Mom Agreement. If you do not agree, do not use the Platform.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to create an account or use the Platform. The Platform is not directed to anyone under 18, and minors may not create accounts, post Tasks, or perform Tasks. A Member may arrange a Task for the benefit of another person (for example, a college student), but the Member remains responsible for the Task and for complying with these Terms. You may not use the Platform if Momsity has previously removed you or if you are barred from doing so under applicable law.
3. Momsity is a marketplace, not a service provider
Momsity provides an online marketplace that lets people who need help (“Members”) connect with independent people who offer help (“Moms”) for everyday tasks (“Tasks”). Momsity does not perform Tasks, does not direct or control how a Mom performs a Task, and is not a party to the arrangement between a Member and a Mom except as these Terms expressly say. Moms are independent contractors and are not employees, agents, joint venturers, or partners of Momsity. Nothing on the Platform creates an employment relationship between Momsity and any user.
Momsity is not an emergency service, a licensed childcare, medical, nursing, home-health, moving, transportation, veterinary, pet-care, home-security, property-management, contractor, legal, or financial provider, or an insurance company. Do not use the Platform for emergencies. Call 911 in an emergency.
Momsity only helps Members and Moms find each other and pay through the Platform. Any Task, and any decision to let a Mom into a home, give out keys or access codes, or leave a pet or property in a Mom's care, is solely between the Member and the Mom.
4. Accounts and verification
You must provide accurate, current, and complete information and keep it up to date. You are responsible for all activity under your account and for keeping your login credentials secure. Tell us right away at help@momsity.com if you believe your account has been compromised.
Any trust level, badge, review, or verification step shown on the Platform reflects only the specific check or activity it describes. Unless a page expressly says otherwise for a specific Mom, Momsity does not conduct criminal background checks, does not verify licenses, insurance, vehicle condition, or driving records, and does not endorse or guarantee any user. You are responsible for deciding whether a Member, Mom, or Task is right for you.
5. Tasks
Members must describe Tasks honestly and completely, including any risks, and must not post Tasks listed in the Prohibited Tasks Policy. Posting a Task does not guarantee that a Mom will offer, accept, or complete it. Matching depends on location, timing, service area, Task type, eligibility rules, and Mom availability. Momsity may decline, edit, hide, or remove any Task at any time, including Tasks that appear unsafe, unlawful, or inconsistent with our policies.
6. Payments, holds, and release to Moms
Members pay for Tasks through the Platform's checkout, which is processed by our payment processor, Stripe. By paying, you authorize the charge shown at checkout. The amount shown to the Member is the total for the Task; the amount shown to the Mom is her payout. Momsity keeps the difference as its service fee. Prices and fees are shown before you pay and may change for future Tasks.
- Funds are held until completion is confirmed. Payment for a Task is held and is not released to the Mom when the Mom accepts or marks the Task complete.
- Member confirmation. After the Mom marks a Task complete, the Member should confirm completion or open a review if something went wrong.
- Automatic confirmation. If the Member does not confirm or open a review within 72 hours after the Mom marks the Task complete, Momsity may confirm the Task automatically, as long as no review, dispute, or open safety, payment, or eligibility issue applies and the Member's payment has settled. Silence within that window counts as confirmation. Automatic confirmation is not a payment to the Mom's bank account.
- After confirmation. Once a Task is confirmed, the Mom's earning is recorded, and eligible earnings may be transferred to the Mom's connected Stripe balance when her payout account is ready. Deposits from that balance to her bank follow Stripe's payout schedule and may take additional time.
- Reviews and holds. If a review or dispute is opened, or if the payment is disputed with a card issuer, the payout stays on hold while Momsity reviews it. Momsity may also hold any payout where it reasonably suspects fraud, a policy violation, or an error.
Payouts to Moms are made through Stripe Connect and are subject to Stripe's terms, verification, and timing. Momsity does not guarantee when a transfer or bank deposit will arrive and is not responsible for delays caused by Stripe, banks, or incomplete payout information.
7. Cancellations, refunds, and Task reviews
Cancellations and refunds are governed by the Cancellation & Refunds policy. In short: if a Member cancels before a Mom accepts, the Member receives a full refund; after a Mom accepts, refunds and partial refunds are at Momsity's reasonable discretion based on the facts. A Member who believes a Task was not performed as described must open a review through the Platform before the Task is confirmed. Momsity's decision on a review is final as between Momsity and the users involved, except for rights you have under Section 19 or that cannot be waived by law.
Automated decisions. Momsity may use automated, rules-based decisions for routine matters: deciding routine Task reviews (for example, a no-show with no reply from the Mom, or a quality concern the Mom answered with completion proof), issuing the resulting refund when no money has reached the Mom, paying earned promotional bonuses, cancelling unpaid Tasks whose date has passed, and approving services once the required credentials are approved. Each automated decision is logged with its reasons, and the people affected are told by email. Either party may ask for a human review of an automated review decision within 14 days from the link in that email; a person then looks at it again. Matters involving safety, injury, property damage, theft, fraud, chargebacks, business or licensed Providers, or larger amounts always go to a person. Automated tools never suspend or ban an account on their own.
8. Chargebacks, fraud, and recovery
You agree to contact Momsity at help@momsity.com and use the Platform's review process before filing a chargeback or payment dispute with your bank or card issuer. If you file a chargeback that is not upheld, or a chargeback for a Task that was performed, Momsity may suspend your account and recover the disputed amount and any related fees from you.
If Momsity determines that a Task was fraudulent, not performed, or paid in error, or a Member's payment is reversed, Momsity may reverse, withhold, or offset the related payout, recover amounts already paid from the Mom's future payouts or through Stripe, and pursue other lawful remedies. Momsity may report suspected fraud to payment processors and law enforcement.
9. Keep it on Momsity
Momsity invests in finding, matching, and protecting users. You agree not to use the Platform to find a Member or Mom and then arrange or pay for Tasks with that person outside the Platform, including by asking to be paid in cash or through another app, sharing personal contact or payment details to avoid Momsity, asking someone to cancel and pay privately, or steering a Task to another marketplace. Repeat Tasks should be booked through “Book this Mom again.” Payments made outside the Platform are not protected by Momsity holds, reviews, or support. Momsity may suspend or remove accounts that circumvent the Platform.
10. Your conduct
You agree not to:
- post or perform prohibited, unlawful, dangerous, or deceptive Tasks;
- provide false information or impersonate anyone;
- harass, threaten, discriminate against, or harm any person;
- commit fraud, file false reviews or disputes, or manipulate ratings;
- collect or misuse other users' personal information;
- scrape, reverse engineer, overload, or interfere with the Platform or its security, or access it with bots or automated tools without permission; or
- violate any law or these Terms.
11. Messages and automated moderation
Task messages are provided to help users coordinate Tasks. Momsity may use automated tools, including third-party AI services, and human review to screen messages and Task content for safety, privacy, fraud, and off-platform payment attempts, and may block, hide, or flag content. Automated flags do not by themselves permanently ban an account.
12. Reviews and your content
You own the content you submit, such as Task descriptions, messages, photos, and reviews. You grant Momsity a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, use, copy, display, modify, and distribute your content to operate, improve, promote, and protect the Platform. Reviews must be honest and based on a real Task. Momsity may remove content that violates these Terms but is not obligated to monitor content.
13. Momsity's intellectual property
The Momsity name, logo, marks, software, design, and content are owned by Ryan Lenhart LLC or its licensors and are protected by law. We give you a limited, revocable, non-transferable license to use the Platform for its intended purpose. If you send us feedback, we may use it without obligation to you.
14. Suspension and termination
You may close your account at any time by contacting help@momsity.com. Momsity may suspend, limit, or terminate your account, remove content, or hold payouts at any time if we reasonably believe you violated these Terms, created risk or legal exposure for Momsity or others, or as required by law. Sections that by their nature should survive termination (including payment obligations, chargeback recovery, disclaimers, limitation of liability, indemnification, and dispute resolution) survive.
15. Assumption of risk and release
Tasks are performed by independent users, often in homes, vehicles, or public places. You understand that meeting people and performing or receiving help carries inherent risks, including property damage, personal injury, and loss. To the fullest extent permitted by law, you voluntarily assume those risks, and you release Momsity and its owners, members, managers, employees, and agents from claims, demands, and damages of every kind, known or unknown, arising out of or connected with any Task or any interaction between users. If you are a California resident, you waive California Civil Code Section 1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
Pets, homes, and property. For pet sitting, dog walking, house sitting, waiting at home, and similar Tasks, the Member is responsible for disclosing an animal's health, behavior, bite history, and care needs, for securing valuables, and for deciding what access to give. Momsity is not responsible for the illness, injury, loss, escape, or death of any animal, for bites or other harm caused by an animal, or for theft, loss, or damage to a home, vehicle, or property, and these risks are included in the release above. Members should keep their own homeowner's, renter's, or pet insurance.
16. Disclaimer of warranties
The Platform and all Tasks are provided “as is” and “as available.” To the fullest extent permitted by law, Momsity disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Platform will be uninterrupted, secure, or error-free. Momsity does not warrant the identity, background, qualifications, conduct, or work of any user and does not guarantee the quality, safety, timing, or legality of any Task.
17. Limitation of liability
To the fullest extent permitted by law, Momsity and its owners, members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, or for personal injury, property damage, or emotional distress arising from any Task or the conduct of any user, whether based on contract, tort (including negligence), or any other theory, even if advised of the possibility of such damages. Momsity's total liability for all claims relating to the Platform or these Terms will not exceed the greater of (a) the service fees you paid to Momsity in the 12 months before the event giving rise to the claim or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow certain disclaimers or limits, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for fraud or gross negligence where that rule applies.
18. Indemnification
You agree to defend, indemnify, and hold harmless Momsity and its owners, members, managers, employees, and agents from and against any claims, liabilities, damages, losses, fines, and expenses, including reasonable attorneys' fees, arising out of or related to (a) your use of the Platform, (b) any Task you post, accept, perform, or receive, (c) your content, (d) your violation of these Terms or any law, or (e) your violation of any third party's rights.
19. Arbitration agreement and class-action waiver
Please read this section carefully. You and Momsity agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, any Task, or your relationship with Momsity (“Dispute”) will be resolved by binding individual arbitration rather than in court, except as stated below.
- Informal resolution first. Before starting arbitration, you or Momsity must send a written notice describing the Dispute and the relief sought (to help@momsity.com for notices to Momsity) and try in good faith to resolve it for 30 days.
- Rules and forum. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules (or another mutually agreed provider), before a single arbitrator. The Federal Arbitration Act governs this section. The arbitration may be conducted by video, by phone, or based on written submissions, or in person in the county where you live or another mutually agreed location. Fees are allocated according to the provider's rules.
- Class-action and jury waiver. You and Momsity may bring claims only in an individual capacity, not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or award class-wide relief. You and Momsity waive any right to a jury trial.
- Small claims and exceptions. Either party may bring an individual claim in small claims court if it qualifies. Either party may seek injunctive relief in court for infringement or misuse of intellectual property or unauthorized access to the Platform.
- Mass filings. If 25 or more similar arbitration demands are filed by or with the help of the same counsel or coordinated parties, they may be administered in batches under the provider's mass-arbitration procedures.
- 30-day opt-out. You may opt out of this arbitration agreement by emailing help@momsity.com within 30 days after you first accept these Terms, with your name, account email, and a clear statement that you opt out of arbitration. Opting out does not affect the rest of these Terms.
- Severability. If the class-action waiver is found unenforceable for a claim, that claim must be severed and heard in court, and the rest of this section still applies. This section survives termination of your account.
20. Governing law and venue
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules, and by the Federal Arbitration Act. For any Dispute not subject to arbitration, you and Momsity consent to the exclusive jurisdiction of the state and federal courts located in Michigan.
21. Time limit to bring claims
To the extent permitted by law, any claim relating to the Platform or these Terms must be brought within one year after the claim arises, or it is permanently barred.
22. Electronic communications
You consent to receive agreements, notices, receipts, and other communications from Momsity electronically, including by email, in-app notification, and posting on the Platform, and agree that electronic communications satisfy any legal requirement that they be in writing.
23. Taxes
You are responsible for any taxes arising from your use of the Platform, except where Momsity or its payment processor is required by law to collect, withhold, or report amounts. Moms are responsible for taxes on their earnings.
24. Changes to these Terms or the Platform
We may update these Terms from time to time. If we make material changes, we will notify you by email, in the app, or by posting a notice, and may ask you to accept the updated Terms. Changes apply going forward from their effective date. Continuing to use the Platform after the effective date means you accept the updated Terms. We may change, suspend, or discontinue any part of the Platform at any time.
25. General
These Terms, together with the policies they reference, are the entire agreement between you and Momsity about the Platform. If any provision is held unenforceable, it will be enforced to the maximum extent possible and the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Momsity is not liable for delays or failures caused by events beyond its reasonable control, such as natural disasters, outages, labor disputes, or acts of government. Headings are for convenience only.
